Terms of Service & Policies
These terms govern estimates, painting services, warranties, and use of this website provided by G & K Quality Painting Services. Please read them carefully — booking a project means you agree to them.
01 Agreement to These Terms
These Terms of Service (“Terms”) form a binding agreement between you (“you,” the “Customer,” or “Homeowner”) and G & K Quality Painting Services (“G & K,” “we,” “us”). By requesting an estimate, signing a proposal, making a payment, or using this website, you agree to these Terms. A signed written proposal or work order, together with these Terms, is the complete agreement for your project and controls if there is any conflict with verbal statements.
02 Who We Are & What We Do
G & K provides residential and light commercial painting and related services throughout the greater Tampa Bay area, including:
- Interior and exterior painting
- Cabinet refinishing
- Pressure washing
- Drywall repair, patching, caulking, and priming
- Surface preparation and minor carpentry incidental to painting
03 Estimates, Quotes & Proposals
Estimates are provided free of charge and are based on a visual inspection of the areas to be painted. Unless stated otherwise, a written estimate is valid for 30 days and is not a binding contract until accepted in writing by both parties. Pricing may be revised if conditions differ materially from what was visible at the time of the walkthrough (for example, hidden rot, water damage, mold, failed prior coatings, or unpermitted structures).
04 Scope of Work & Change Orders
We will complete the work described in your signed proposal. Anything not expressly listed is excluded. Requests to add areas, change colors after work begins, or address newly discovered conditions require a written change order describing the added work and cost. Work under a change order may extend the project timeline.
05 Pricing, Deposits & Payment
- Deposit. Many projects require a deposit to reserve your date and cover initial materials. The deposit amount is stated in your proposal.
- Progress & final payment. The balance is due upon substantial completion and your walkthrough approval, unless a milestone schedule is written into the proposal.
- Accepted methods. Cash, check, and approved electronic payments. Returned checks may incur a fee.
- Late payments. Balances unpaid past the due date may accrue interest at the maximum rate permitted by Florida law and are subject to reasonable collection and attorney fees.
06 Scheduling, Delays & Cancellation
Start and completion dates are good-faith estimates. Exterior work is weather-dependent; rain, high humidity, or unsafe temperatures may require us to pause and reschedule for proper adhesion and curing. We are not liable for delays caused by weather, material shortages, or conditions outside our control.
You may cancel before work begins; deposits may be non-refundable to the extent they cover materials already purchased or scheduling held on your behalf. Cancellation after work has started is billed for labor and materials completed to date.
07 Color Selection & Approval
You are responsible for final color, sheen, and product selections. Colors can appear different across lighting, surfaces, and monitors, and sample swatches are approximations. We recommend approving a test area before full application. Once you approve colors and we begin, repainting in a different color is treated as a change order.
08 Surface Prep & Existing Conditions
Standard preparation includes cleaning, scraping loose material, sanding, patching minor imperfections, caulking, and spot priming as needed for a sound finish. Paint adheres to the existing surface; we cannot guarantee results over previously failing coatings, incompatible products, or unstable substrates. Structural repair, extensive rot, mold remediation, and pest issues are outside our scope unless separately quoted.
09 Lead-Based Paint Disclosure
Homes built before 1978 may contain lead-based paint. Federal EPA Renovation, Repair and Painting (RRP) rules require lead-safe work practices in these homes. If your property predates 1978, let us know so we can follow the required procedures and provide the EPA pamphlet “Renovate Right.”
10 Materials & Product Warranties
Unless your proposal states otherwise, G & K supplies quality paints and materials suited to the job. Paints, stains, and coatings carry the manufacturer's own warranty, which is separate from our workmanship warranty. We pass through manufacturer warranties where applicable but do not warrant product performance beyond their terms.
11 Workmanship Warranty
We warrant our labor against defects in workmanship such as peeling, blistering, or excessive flaking caused solely by our application, for a period stated in your proposal (commonly two years from completion). Our sole obligation under this warranty is to repair or repaint the affected area using comparable materials, at no labor cost to you.
12 Warranty Exclusions
The workmanship warranty does not cover:
- Normal wear, fading, or chalking from sun and weather
- Cracks or nail pops from settling, movement, or moisture intrusion
- Surfaces we advised against painting or that you directed us to paint
- Damage from leaks, flooding, mildew, abrasion, or improper cleaning
- Bleeding stains, tannin, or rust from the underlying substrate
- Work altered, repaired, or repainted by others
- Areas where you declined recommended preparation or priming
Warranty service requires that your account is paid in full and that you notify us in writing within a reasonable time of discovering the issue.
13 Homeowner Responsibilities
- Provide safe, clear access to the work areas during scheduled hours
- Move or protect valuables, electronics, and fragile items in advance
- Secure pets and keep children away from work zones, ladders, and materials
- Provide access to water and electricity as needed
- Disclose known hazards such as wasp nests, wiring issues, or prior water damage
We take reasonable care to protect your property with drop cloths and masking, but we recommend removing items of high sentimental or monetary value from the work area.
14 Licensing & Insurance
G & K operates as a licensed and insured painting contractor. Certificates of insurance are available on request. We carry coverage appropriate to our services; nothing in these Terms transfers our insurance obligations to you.
15 Limitation of Liability
To the fullest extent permitted by law, G & K's total liability arising out of a project is limited to the amount you paid for that project. We are not liable for indirect, incidental, or consequential damages, including lost use, delay, or diminished value. This section does not limit liability that cannot be limited under Florida law.
16 Indemnification
You agree to indemnify and hold G & K harmless from claims arising out of your breach of these Terms, your misrepresentation of property conditions, or hazards on your property that you failed to disclose, except to the extent caused by our negligence or willful misconduct.
17 Project Photography & Marketing
We may photograph completed work for our portfolio, website, and social media. Photos are limited to the finished project and never include identifying personal information or your exact address without consent. If you prefer we not photograph your project, tell us in writing before work begins and we will honor it.
18 Privacy Policy
When you contact us or request an estimate, we may collect your name, phone number, email, project address, and details you provide. We use this information only to prepare estimates, schedule and perform work, process payments, and follow up on your project.
- We do not sell your personal information.
- We share information only with staff and subcontractors as needed to complete your work, or when required by law.
- We keep records as long as needed for warranty, tax, and legal purposes.
- You may request that we correct or delete your information by contacting us.
20 Accessibility
We want this site to be usable by everyone and aim to follow recognized accessibility guidelines. If you have trouble accessing any part of this site or need information in another format, call us and we will help.
21 Disputes & Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us so we can try to resolve the issue in good faith. Any dispute that cannot be resolved will be handled in the state or county courts located in the county where the work was performed.
22 Changes to These Terms
We may update these Terms from time to time. The version in effect on the date you sign your proposal applies to that project. The latest version is always posted on this page with its effective date.
